The purpose of the Buddibot is to provide a one place to be able to store and access medical information of their loved ones. It further facilitates navigation of Rovio(TM) by WowWee Group Ltd., and provides a reminder system that each subscriber can personalize by following the instructions for adding information regarding the drugs, doses and dosing times, treatment and diet reminders, for which the subscriber wants a reminder. The Buddibot is intended to be a convenient source of medical information and reminder notices, but it is not intended to be, in any respect, a substitute for medical care. The subscribers of Buddibot are directly responsible for the content stored and Buddibot is not responsible for misuse and/or misinterpretation by the user. Don't rely on the information accessed through the Buddibot, as your sole source of medical information. BUDDIBOT IS ONLY A SOFTWARE SERVICE AND IS NOT RESPONSIBLE FOR THE WORKING AND WARRANTY OF ROVIO.
The use of the Buddibot and the content provided is at your own risk. When using the Buddibot, information will be transmitted over wireless communication networks that may be subject to coverage outages that are not within the control of Buddibot or their suppliers and licensees. Accordingly, Buddibot and their suppliers and licensees assume no liability for the delay, failure, interruption, or corruption of any data or other information transmitted via Rovio(TM) to or from the Buddibot.
The Buddibot and the content are provided on an "as is" basis. BUDDIBOT, THEIR LICENSORS, LICENSEES AND THEIR SUPPLIERS DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS. Without limiting the foregoing, Buddibot, their licensors, and their suppliers make no representations or warranties about the following: (1) the accuracy, reliability, completeness, or timeliness of the content, software, text, graphics, links, or communications provided on or through the Buddibot; or (2) the satisfaction of any government regulations requiring disclosure or storage of medical information.
In no event shall Buddibot, their licensors, licensees or their suppliers be liable for any damages resulting from the use of or inability to use the Buddibot or the content provided on the Buddibot, whether based on theories of warranty, contract, tort, or any other legal theory, and whether or not Buddibot, their licensors, licensees or their suppliers are advised of the possibility of such damages. In the event of any liability, Buddibot, their licensors, licensees and their suppliers' total responsibility to pay damages shall not exceed actual damages incurred by the subscriber, not to exceed the lesser of U.S. $ 50 or the amount paid by subscriber for the Buddibot service. Any claim arising in connection with the use of the Buddibot or any content must be brought within one (1) year of the date of the event giving rise to such action. The remedies described in this section are exclusive and are limited to those expressly provided for herein. UNDER NO CIRCUMSTANCES SHALL BUDDIBOT, THEIR LICENSORS, LICENSEES AND THEIR SUPPLIERS BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE.
Consent to Use of Data. You agree that Buddibot and its subsidiaries may collect and use technical and related information, including but not limited to technical information about your computer, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Buddibot Software and to verify compliance with the terms of this License.ÊBuddibot may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.
Rovio and other Services. This Buddibot software enables access to navigation of Rovio(TM). The navigation and other services require Internet access and use of certain Services requires you to accept additional terms of service which will be presented to you before you can use such Services. Rovio(TM) terms of use is as defined by WowWee Group Ltd. and Buddibot is not responsible for any hardware related issues.
Certain Services may include materials from third parties or links to certain third party web sites. You acknowledge and agree that Buddibot is not responsible for examining or evaluating the content or accuracy of any such third-party material or web sites. Buddibot does not warrant or endorse and does not assume and will not have any liability or responsibility for any third-party materials or web sites, or for any other materials, products, or services of third parties. Links to other web sites are provided solely as a convenience to you. You agree that you will not use any third-party materials in a manner that would infringe or violate the rights of any other party, and that Buddibot is not in any way responsible for any such use by you.
You agree that the Services, including but not limited to graphics, audio clips, and editorial content, contain proprietary information and material that is owned by Buddibot and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity.
Buddibot and its licensors reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will Buddibot be liable for the removal of or disabling of access to any such Services. Buddibot may also impose limits on the use of or access to certain Services, in any case and without notice or liability.
Termination. This use of service is effective until terminated. Your rights under this service agreement will terminate automatically without notice from Buddibot if you fail to comply with any term(s) of this agreement.
Disclaimer of Warranties. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE BUDDIBOT SOFTWARE AND SERVICE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.
